New York pays everyone the same number of weeks
Most states vary duration with work history, so a shorter record means a shorter claim. New York does not. The federal table records its duration as uniform, which is why there is no maximum-benefit-amount formula to apply: eligibility is the gate, and once through it the claim length is the same for everyone.
- Uniform 26 weeks. The duration column reads "uniform 26" and the maximum benefit amount column reads N/A. A claimant who barely qualifies gets the same number of payable weeks as one with years of high earnings.
- The weekly range is $140 to $869. That $869 ceiling is among the highest in the country, and the $140 floor is well above the $40 to $55 minimums common in the south.
- The divisor is banded, 1/25 to 1/26 of high-quarter wages. As in California, the effective divisor moves with earnings rather than being fixed.
- Qualifying needs $3,500 in the high quarter and 1.5 times that across the base period. The second half of that test is what prevents one strong quarter from carrying a claim on its own.
- You may work up to 10 hours a week. New York disregards up to 10 hours of work so long as earnings stay at or below the weekly benefit amount — an hours-based rule, not a dollar-based one, and unusual for that reason.
